Acceptance of Terms
By accessing byteforgelab.com, downloading or using any ByteForgeLab product, or engaging our development services, you ("User", "Customer", or "Client") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree with any part of these Terms, you must not use our website or products. If you are entering these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
Important: Purchases of products listed on third-party marketplaces are also subject to that marketplace's own terms of service in addition to these terms.
Our Services
ByteForgeLab provides the following categories of services:
- Commercial software products — ready-to-deploy plugins, scripts, and applications sold on a one-time licence basis.
- Custom software development — bespoke web applications, APIs, dashboards, and automation tools built to client specifications under a separate project agreement.
- Consulting & technical advisory — architecture reviews, code audits, and technology guidance provided under a separate engagement agreement.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. In the event a product is discontinued, customers who have purchased a licence will retain access to the last released version.
Product Licences
Regular Licence
A Regular Licence grants you the right to use the product on a single end product for a single end user (yourself or your client). The end product may not be sold or charged for separately. Regular licences are sold through third-party marketplaces and are subject to third-party marketplace's licence terms in addition to these Terms.
Extended Licence
An Extended Licence grants you the right to use the product in an end product that is sold or distributed to multiple users (e.g. a SaaS product, a client project billed to the client, or a theme/plugin bundle). See individual product listings for Extended Licence availability and pricing.
Restrictions — all licences
- You may not redistribute, resell, sublicence, or transfer the product to a third party without explicit written permission from ByteForgeLab.
- You may not remove or alter any copyright notices, licence headers, or attribution embedded in the source code.
- You may not use the product to create a competing product that is substantially similar to the licensed product.
- Reverse engineering for the purpose of circumventing licence restrictions is prohibited.
You can: modify the source code for your own use, use the product on multiple sites if you have a Regular Licence for each, and seek support during the support period included with your purchase.
Payment & Refunds
Product purchases
All product purchases are processed through third-party marketplace platforms. Payment terms, accepted methods, and currency conversion are governed by the marketplace's policies. ByteForgeLab does not store or handle payment card information.
Custom development projects
Custom project payment terms are agreed in writing before work commences and are detailed in the project proposal or Statement of Work. Typical terms include an upfront deposit (30–50%) with the remainder due on delivery or at agreed milestones.
Refunds — commercial products
- Refunds for marketplace purchases are subject to the marketplace's refund policy.
- Refunds will not be issued for reasons of personal preference, incompatibility with customised WordPress installations, or failure to read product requirements before purchase.
- If a product has a confirmed defect that cannot be resolved within a reasonable timeframe, we will offer a full refund.
Refunds — custom development
Deposits are non-refundable once work has commenced. Final payment milestone refunds are governed by the specific project agreement. In the event of a dispute, both parties agree to good-faith mediation before pursuing formal legal remedies.
Acceptable Use
You agree not to use ByteForgeLab products or services for any of the following purposes:
- Any illegal activity or activity that violates applicable local, national, or international laws or regulations.
- Sending unsolicited bulk communications (spam) using any of our email or messaging integration features.
- Distributing malware, viruses, or any other malicious code.
- Attempting to gain unauthorised access to any system, network, or data.
- Infringing the intellectual property rights of third parties.
- Impersonating ByteForgeLab or any ByteForgeLab team member in communications or on any platform.
- Using our AI-integrated products to generate content that is defamatory, harassing, discriminatory, or otherwise harmful.
Violation of this section may result in immediate termination of your licence and, where appropriate, referral to law enforcement authorities.
Intellectual Property
All ByteForgeLab products, source code, documentation, design assets, trade marks, and branding ("ByteForgeLab IP") are owned by ByteForgeLab and protected by applicable copyright, trade mark, and intellectual property laws.
Purchasing a licence grants you a limited, non-exclusive, non-transferable right to use the product as described in Section 03. It does not transfer ownership of the underlying intellectual property.
Customer content
For custom development projects, unless otherwise agreed in writing, intellectual property created specifically for your project and fully paid for shall be assigned to you upon final payment. ByteForgeLab retains ownership of any general-purpose libraries, frameworks, or components developed independently of your project that are incorporated into the deliverable — you receive a licence to use these as part of the project deliverable.
Feedback
If you submit suggestions, ideas, or feedback about our products, you grant ByteForgeLab a royalty-free, worldwide, irrevocable licence to use that feedback for any purpose, including improving our products, without obligation to you.
Warranties & Disclaimers
ByteForgeLab products are provided with the following limited warranty: each product will perform materially in accordance with its published documentation for a period of 6 months from the date of purchase.
To the maximum extent permitted by applicable law, ByteForgeLab expressly disclaims all other warranties, express or implied, including but not limited to:
- Implied warranties of merchantability or fitness for a particular purpose.
- Warranties that products will be error-free or uninterrupted.
- Warranties regarding the results that may be obtained from use of the products.
- Warranties that any defects in the products will be corrected within a specific timeframe.
Please note: Our products integrate with third-party services (WooCommerce, WordPress, Anthropic Claude, Twilio, etc.). We do not warrant the availability, accuracy, or reliability of these third-party services. Ensure you review the terms of all integrated third-party services.
Limitation of Liability
To the maximum extent permitted by applicable law, ByteForgeLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of business opportunity, arising out of or related to your use of our products or services, even if ByteForgeLab has been advised of the possibility of such damages.
ByteForgeLab's total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of:
- The total amount paid by you for the specific product or service giving rise to the claim in the 12 months preceding the claim; or
- USD $100.
Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
Support & Updates
Standard support period
All commercial products include 6 months of free support from the date of purchase. During this period, ByteForgeLab will:
- Respond to support requests submitted through the marketplace support system within 2 business days.
- Provide bug fixes for confirmed product defects.
- Release compatibility updates for major WooCommerce and WordPress versions released during the support period.
What support covers
- Bugs or issues within the product itself.
- Installation and configuration guidance as documented.
- Clarification of documented features.
What support does not cover
- Customisation requests or feature additions beyond the documented product scope.
- Issues caused by third-party plugins, themes, or custom code conflicts.
- Issues arising from modifications made to the product source code.
- General WordPress or WooCommerce support unrelated to the product.
Extended support
Extended support beyond 6 months may be available for purchase. Contact hello@byteforgelab.com for extended support pricing.
Termination
ByteForgeLab may terminate or suspend your licence and access to our products immediately, without prior notice or liability, if you breach any provision of these Terms. Upon termination:
- Your right to use the product ceases immediately.
- You must destroy all copies of the product in your possession.
- Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.
You may terminate your use of our products at any time by ceasing to use them. Termination does not entitle you to a refund unless a defect-based refund right applies as described in Section 04.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. The Nigeria Data Protection Act 2023, the Federal Competition and Consumer Protection Act 2019, and other applicable Nigerian statutes shall apply where relevant.
For customers located in other jurisdictions, mandatory consumer protection laws of your jurisdiction may also apply and shall take precedence where required by law.
Dispute resolution
- Informal resolution: Both parties agree to first attempt to resolve any dispute informally by contacting legal@byteforgelab.com. We will make a good-faith effort to respond within 10 business days.
- Mediation: If informal resolution fails within 30 days, both parties agree to attempt mediation before commencing any formal legal proceedings.
- Courts: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and post a notice on our website homepage.
Your continued use of our products or services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using our products and services. We will not retroactively change the terms that applied to products already purchased.
